Photoshoot Contract

BOOKING POLICY

1. Deposits (non-refundable) cover time and talent only and secure your session date and current prices.

2. Deposit is due at time of booking to secure your session. Remaining balance is due the day of the session.

3. You are responsible for covering additional fees and costs related to location choice (admission fees, parking, etc.).

4. Travel up to 25 miles from 34771 is included. 

5. If someone becomes ill, please call as soon as possible to reschedule your session. I maintain the right to reschedule if needed due to weather, illness, emergency, etc.

PROOFING AND ORDERING

1. Approximately 5-7 business days after the session I will post your proofs in an online gallery for you to chose the ones you like. This gallery will be hosted for 30days so please be prepared to place your order in that time frame.

2. Be sure to inspect your images carefully in your gallery. Once images and products are sent, all sales are final.

3. Creative privilege - there are times when an image needs a certain crop or a particular treatment. I will do my best to match your tastes, but I need to have the freedom to decide how to make an image look its absolute best.

4. I cannot begin to process orders until payment is complete.

5. If you have a request for a small change to an image, please let me know when you chose your photo in the comment section. I can address minor changes at no cost (fix blemishes, tighter crop, etc.), but more involved requests (head swapping, etc.) are billed at $25/hr. I will let you know if there will be extra charges before work is begun. Once the requested changes are made, charges apply regardless if the final product is purchased.

6. I do not release RAW (unedited) images.

7. All unordered images will be purged after 90 days.

MODEL RELEASE

In exchange for consideration received, I hereby give permission to Valen PerezPhotography to use my name (and all parties in this photo session) and photographic likeness in all forms and media (Facebook, Instagram, blogs, webpage, etc.) for advertising, trade, and any other lawful purposes. I do hereby release to Valen Perez Photography, its agents, and employees all rights to exhibit this work in print and electronic form publicly or privately and to market and sell copies. I waive any rights, claims, or interest I may have to control the use of my identity or likeness in whatever media used.

ON-TIME POLICY

1. Late Arrival and Time Reduction: If the Client is late for the scheduled photoshoot session, the Photographer reserves the right to reduce the session time to the remaining duration originally agreed upon. The Photographer shall not be held responsible for any missed content or shots due to the Client's tardiness.

2. Session Extension Fee: In the event that the Client wishes to extend the session beyond the initially agreed-upon time, an extension fee of $50 will be charged foreach additional 30-minute increment. This fee must be paid in full before the extension is granted.

3. Automatic Rescheduling for Excessive Lateness: If the Client is delayed by more than 40 minutes from the scheduled start time, the Photographer reserves the right to automatically reschedule the photoshoot session for a new date and time. The rescheduling will be subject to mutual availability and agreement between thePhotographer and the Client.

4. Notification of Lateness: It is the responsibility of the Client to inform thePhotographer as soon as possible in case of anticipated lateness. The Photographer will make reasonable efforts to accommodate minor delays, but excessive lateness may result in the application of the automatic rescheduling clause.

CHILDREN'S BEHAVIOR DISCLAIMER CLAUSE

1. Individuality of Children: The Client acknowledges and understands that all babies and kids are unique individuals, and their behavior during the photoshoot cannot be predicted or guaranteed. The Photographer shall not be held responsible for the natural and unpredictable variations in children's mood, temperament, or behavior.

2. No Guarantee of Smiles or Specific Actions: The Photographer cannot guarantee that the child will smile, participate in specific activities, eat the cake, or engage in particular poses during the photoshoot. The primary goal of the session is to capture the genuine personality, expressions, and preferences of the child.

3. Flexibility in Approach: The Photographer will make reasonable efforts to create a comfortable and enjoyable environment for the child during the photoshoot.However, the Photographer reserves the right to adapt the session based on the child's behavior and preferences to achieve the best possible results.

4. Parental Cooperation: The Client agrees to provide information about the child's likes, dislikes, and any specific concerns in advance of the photoshoot. ThePhotographer will take this information into consideration but cannot guarantee that the child will respond in a specific manner.

5. Creative Interpretation: The Photographer has the creative discretion to capture the child's personality in a way that reflects the unique essence of the individual. TheClient trusts the Photographer's professional judgment in crafting memorable and authentic images.

6. Release of Responsibility: The Client releases the Photographer from any liability or responsibility for the child's behavior, actions, or lack of cooperation during the photoshoot. The Client acknowledges that capturing the child's genuine personality may involve moments of spontaneity and unpredictability.

OTHER

1. Valen Perez Photography is not responsible for any injury during my session. 

2. You will not receive a refund if you decide to cancel or change the type of session you’re booking. You may use the additional funds to purchase prints or more digital images or you may use the balance for a future session. 

3. Your edited images are the photographer’s art. Please be respectful and do not edit images after you’ve received them. This includes adding text or graphics to your images. 

4. Valen Perez Photography retains copyright to your images. You may purchase digitals with the rights to print them, but you do not own the photos. 

5. All sales are final.
